咨询一下关于宅基地的问题。而且我家的房子还没有房产证无法明确说明我家的宅基地具体的范围,还能强制让邻居把围墙给砌起来吗?
我家房前原本有一无人池塘,十多年前我家拉土给填平了,在去年年初的时候我用砖头砌了个一米左右高的围墙把那个填平的池塘给围了起来准备种个菜栽个树什么的。但是邻居不愿意了,他说我们围的围墙妨碍他走路了(原本在池塘的南边紧邻池塘边有一条三米左右宽的路),而在围墙外边留的路还有四米宽呢,邻居还说路太窄他的车过不去,后来经村支书协调我又把围墙往里面赶了五十公分,现在留有四米半宽的路,邻居也同意了。但问题是在今年年初的时候邻居家的大儿子回来了,没有通知任何人邻居的大儿子就去拆我家围的围墙,在拆的过程中被我四叔看到了,我四叔去制止他,他不听反而和他弟弟还有他爸妈围殴我四叔。在我家人发现时,打斗已经结束,邻居也回去了。这时我就报警了,在警察赶过来之前,邻居又一次出来拆我家围墙,我妈妈看到后就过去制止,结果邻居丢掉榔头就去打我妈妈,当时我家人和亲戚都在场就赶紧过去拉架,结果是我妈和我四叔轻微伤,邻居也是轻微伤,都在医院住了一个星期。出院后派出所出面调节,调节结果是各自付各自的医药费,围墙只拆掉几块砖就算了。当时我感觉很憋屈,但也不想把事情闹大就忍了……但是一个多月以后邻居家拉土的时候把我家围的围墙给撞倒了有四五米那么长,我让他把围墙重新砌好,他却不砌了,说什么路太窄大车过不去,要是砌的话还要把围墙往里面赶。后来开车碰倒我家围墙的司机说他愿意给砌起来,就这样邻居还是不让砌,邻居还说即使砌好以后他过车还给我碰倒。实在没办法我就报警了,派出所里来了后说:因为这个池塘之前是无人的属于集体的,而且我家的房子还没有房产证无法明确说明我家的宅基地具体的范围,填平后只能使用不能所有,所以这件事情他们也管不了不予立案。后来我去房产所里咨询,他们说无法开证明说那块土地是属于我的,只能出个证明说我可以长期使用那块土地的证明。请问,像我这种情况我应该怎么办?我还能找邻居要赔偿吗,还能强制让邻居把围墙给砌起来吗?如果起诉的话,在这种情况下我能胜诉吗?咨询一下关于宅基地的问题。而且我家的房子还没有房产证无法明确说明我家的宅基地具体的范围,还能强制让邻居把围墙给砌起来吗?
