我们这里要拆迁了,我的租赁合同还没有到期.可是我交的租金已经到期了,老板让我们现在就搬走.怎么办?

1、告知其在一个合理期限内(如3天)搬离并交清房款,否则向法院起诉。
2、如在告知期限内未搬离,到法院立案庭起诉,并请求诉前财产保全,由法院查封存在房内的货物。
3、起诉还房款、迟延给付房款的同期银行利息、搬离租屋、给付超期租住的租金。

一、注意审查主体资格
(一)出租人是否具备主体资格
出租人是否具备出租房屋的主体资格,直接关系到合同的效力问题,所以应予以充分重视。主要从以下三方面来审查:
1、出租人为自然人的,是否具备完全民事行为能力,审查其居民身份证或户口薄;
2、出租人系法人或其他组织的,是否依法成立,审查其营业执照,看其是否年检并进行必要的工商查询;
3、出租人是否享有出租房屋的实体权利。
(二)承租人是否具备主体资格
审查承租人是否具有合法的身份,如暂住人口承租房屋的,必经持有公安机关核发的暂住证;法人或其他组织的,必经持有合法有效的营业执照。
特别注意:《城市私有房屋管理条例》第二十二条规定:“机关、团体、部队、企业事业单位不能租用或变相租用城市私有房屋。如因特殊需要必须租用,须经县以上人民政府批准。”
二、注意审查房屋是否存在禁止出租的情形
根据《中华人民共和国城市房地产管理法》第五十四条规定:“住宅用房的租赁,应当执行国家和房屋所在城市人民政府规定的租赁政策。租用房屋从事生产、经营活动的,由租赁双方协商议定租金和其他租赁条款。”
根据《城市房屋租赁管理办法》第六条:“有下列情形之一的房屋不能出租:
(一)未依法取得房屋所有权证的;
(二)司法机关和行政机关依法裁定、决定查封或者以其他形式限制房地权利的;
(三)共有房屋未取得共有人同意的;
(四)权属有争议的;
(五)属于违法建筑的;
(六)不符合安全标准的;
(七)已抵押,未经抵押权人同意的;
(八)不符合公安、环保、卫生等主管部门有关规定的;
(九)有关法律、法规规定禁止出租的其他情形。”
三、注意审查租赁期限
《中华人民共和国合同法》第二十一条规定:“租赁期限不能超过二十年。超过二十年的,超过部分无效。”
应严格仔细审查合同的起租日,同时注意有无在一定期限内免租的约定及是否有表明装修期内免租的约定。
